Terms of Service

The agreement between you and Tapixy for creator accounts, storefronts, affiliate links, and payouts.

Creator login

Last updated: October 26, 2026

PLEASE READ THESE TERMS CAREFULLY. SECTION 13 REQUIRES YOU TO RESOLVE DISPUTES WITH TAPIXY THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. SECTION 5 MAKES CREATOR PAYOUTS CONDITIONAL ON TAPIXY FIRST COLLECTING THE COMMISSION. SECTION 16 LIMITS TAPIXY’S LIABILITY.

1. Agreement and electronic signature

These Terms of Service (“Terms”) are a binding contract between you and Tapixy, together with its owners, operators, and affiliates (“Tapixy,” “we,” “us”). Our Privacy Policy and Affiliate Disclosure are part of these Terms.

By creating an account, logging in, claiming a storefront, or otherwise accessing or using Tapixy, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree, you may not use the service.

You agree that clicking a button to create an account, log in, or claim a storefront is your electronic signature and your consent to these Terms, with the same force as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 et seq.). You consent to receive these Terms, notices, and other records electronically.

2. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to hold a creator account. You are responsible for your username, password, passkeys, and everything that happens under your account. Keep your credentials secret and tell us promptly at contact@tapixy.com if you believe your account has been compromised.

Multiple Accounts & Sybil Prevention Policy. Users, creators, and visitors are strictly prohibited from registering, maintaining, or operating multiple accounts (defined as more than one account per individual, entity, or affiliated network). Tapixy and its administrators reserve the sole and absolute right to automatically freeze, merge, or terminate any and all duplicate or multiple accounts without prior notice to prevent bot manipulation, click fraud, and system abuse. Additional storefronts that Tapixy lets you create inside your one account are not separate accounts.

3. The service

Tapixy is a Link-in-Bio storefront. Creators publish video looks with shoppable items. Visitors follow tracked product links to merchant sites. Tapixy may earn advertising fees (commissions) from qualifying purchases through affiliate networks and merchant programs such as CJ Affiliate and AliExpress (each a “Network”). Tapixy is not the seller of any product and is not a party to any purchase between a shopper and a merchant.

4. Creator earnings: 70 / 30 split

When a Network attributes a qualifying purchase to a creator’s storefront tracking id (sid / subID), the advertising fee the Network reports (“gross”) is split as follows:

  • 70% is the creator share (“Creator Share”).
  • 30% is the platform share for hosting, matching, and payout operations.

The split applies only to advertising fees that we can attribute to your username. It does not apply to product retail prices paid by shoppers. Reported, pending, or estimated amounts shown in your dashboard are informational and are not a promise to pay.

5. Pay-when-paid: payouts depend on Tapixy being paid first

Condition precedent. You expressly agree that Tapixy’s obligation to pay any Creator Share is subject to a condition precedent: Tapixy must first actually receive, in cleared and collected funds, the settled commission from the Network or merchant for the specific attributed sale. Until that condition is met, no Creator Share is owed for that sale.

No liability for Network defaults. If a Network or merchant delays, withholds, reverses, charges back, refuses to pay, offsets, or becomes insolvent or bankrupt with respect to any commission connected to your storefront, Tapixy has no legal or financial obligation to pay you the related Creator Share from its own funds. If a Network reverses or claws back a commission after we have paid you the related Creator Share, we may deduct that amount from your future earnings or ask you to repay it.

6. 90-day clearance hold and payouts

Creator Share is held in pending status for 90 days after the attributed sale date. This 90-day clearance window covers return windows, cancellations, and Network payment timing. After 90 days, eligible amounts that also satisfy Section 5 move to cleared (available). Cleared amounts are paid only after an admin reviews and explicitly approves the payout. Nothing is paid automatically. We may set minimum payout amounts and require accurate payout and tax details before paying you. You are responsible for your own taxes.

7. International creators, taxes, and payout fees

Creators outside the United States. Tapixy is operated from California, USA. If you use Tapixy from outside the United States, you agree that you are contracting with Tapixy under California law and are bound by Sections 13 and 14 (arbitration, governing law, and venue), to the fullest extent permitted by the mandatory laws of your country of residence. You are responsible for complying with the laws that apply to you locally.

Taxes. Tax forms, tax reporting, and withholding are covered in Section 8. You are solely responsible for reporting and paying taxes on your earnings in your home country and anywhere else they are due; Tapixy does not withhold, collect, or remit taxes outside the United States.

Payout and currency fees. You are solely responsible for all third-party payment processor fees, international wire and bank fees, PayPal, Wise, and Payoneer transaction costs, and foreign-exchange conversion spreads or charges. We may deduct these costs directly from your payout total. Payouts are calculated in U.S. dollars; the amount you receive in another currency depends on the processor’s exchange rate at the time of transfer.

8. Tax reporting, Form W-9 / W-8BEN, and backup withholding

U.S. creators (Form W-9 and Form 1099-NEC). If you are a U.S. person, you must give Tapixy a complete and valid IRS Form W-9, including your correct Taxpayer Identification Number (Social Security Number or Employer Identification Number), before you request a payout of cleared earnings once your payments for the calendar year reach the IRS reporting threshold (currently $2,000 per year for payments made in 2026 and later, as adjusted by the IRS). Tapixy may also ask for a Form W-9 at any time before then. Where federal law requires it, Tapixy will issue you an annual IRS Form 1099-NEC for your reportable U.S. earnings and file it with the IRS. Payments reported to the IRS by a payment processor (for example, on Form 1099-K) may not also be reported on Form 1099-NEC.

Non-U.S. creators (Form W-8BEN). If you are not a U.S. person, you must certify your foreign status by completing or confirming IRS Form W-8BEN (individuals) or Form W-8BEN-E (entities). By doing so you certify that you are not a U.S. citizen, U.S. resident, or other U.S. taxpayer and that the services you provide through Tapixy are performed outside the United States. You must tell us within 30 days if any of this changes.

Tax holds and backup withholding. Tapixy may suspend or delay payouts to any creator who has not provided valid tax documentation (Form W-9 or Form W-8BEN) once required by these Terms or by law. If federal tax rules require it, for example because your Taxpayer Identification Number is missing or the IRS notifies us that it is incorrect, Tapixy will apply backup withholding at the statutory rate (currently 24%) and remit the withheld amount to the IRS on your behalf. Withheld amounts reduce your payout and are not refundable by Tapixy.

Independent contractors and sole tax responsibility. You are an independent contractor, not an employee, agent, partner, or joint venturer of Tapixy, and nothing in these Terms creates an employment relationship. Tapixy does not withhold income or payroll taxes from your earnings except as stated above, and you are not eligible for any employee benefits. You are solely responsible for reporting your income, filing your tax returns, and paying all applicable local, state, federal, and international income taxes, self-employment taxes, VAT, GST, and sales taxes on your earnings. Tapixy does not give tax advice; consult a tax professional about your situation.

9. Prohibited activities and fraudulent traffic

Creators are strictly prohibited from engaging in any fraudulent, artificial, deceptive, or malicious activities to generate clicks, impressions, conversions, or affiliate commissions (“Fraudulent Activity”). Prohibited activities include, but are not limited to:

  • Automated & bot traffic: utilizing bots, automated scripts, crawlers, click-farms, proxy networks, or automated traffic-generation software.
  • Cookie stuffing & link manipulation: employing cookie stuffing, pop-unders, hidden iframes, typosquatting, forced clicks, adware, spyware, or unauthorized HTTP header modifications.
  • Prohibited traffic sources: generating traffic through unsolicited bulk messaging (spam), unauthorized pay-per-click (PPC) bidding on trademarked terms, or misleading advertising.
  • Self-referrals & transactional fraud: engaging in self-referral schemes, making unauthorized personal purchases through generated links for rebate extraction, or executing fake purchases followed by systematic chargebacks or order cancellations.

Fraudulent Activity also includes, without limitation: paid-to-click, incentivized-click, or traffic-exchange services; VPN, proxy, data-center, or device-spoofing techniques used to disguise the origin of traffic; purchases by you, your household, or people acting for you, made to earn commissions; automated link wrapping, cloaking, or replacement; fake conversion generators or orders placed with the intent to cancel or return them; and any activity that violates the terms or policies of a participating Network or merchant.

You must not wrap, cloak, or replace Tapixy’s outbound links in a way that violates Network or merchant terms. Product availability, pricing, and images can change without notice.

10. Account suspension, partner compliance, and forfeiture

Right to suspend or terminate accounts. Tapixy reserves the right, at its sole and absolute discretion, to modify, freeze, suspend, or permanently terminate any Creator account, restrict access to the platform, and withhold or cancel any pending or accumulated commission payouts, with or without prior notice, in the event of suspected fraud, violation of these Terms, or risk of financial, operational, or legal liability.

Compliance with partner networks and merchant directives. Tapixy acts as an intermediary facilitating affiliate commerce through third-party networks, merchants, payment processors, and infrastructure providers (including, but not limited to, CJ.com, Amazon PartnerBoost, AliExpress, payment gateway processors, and cybersecurity providers). Tapixy strictly complies with the terms and policies of all affiliated partner networks and merchants. If Tapixy receives an inquiry, abuse report, takedown request, chargeback notification, or directive from any partner network, merchant, payment processor, or legal authority requesting or requiring the suspension or investigation of a Creator, Tapixy shall have the absolute right to immediately freeze or terminate the designated Creator account without liability.

Automated fraud detection. Tapixy employs automated security and fraud-detection systems. Any account flagged by our algorithms for anomalous click velocity, bot traffic, or artificial manipulation will be automatically frozen instantly without prior notice, pending manual administrative review. While an account is frozen, sign-in is blocked, its storefronts are hidden, its tracking links stop earning, all pending and cleared earnings are placed on audit hold, and payout requests are blocked. After review, we will either unfreeze the account or permanently ban it under this Section. If you believe your account was frozen in error, contact contact@tapixy.com.

Right to freeze and audit. Tapixy may, in its sole discretion and without prior notice, immediately freeze, lock, or suspend any creator account, block sign-ins from associated devices, hold all pending and cleared balances, and conduct an internal audit whenever we detect or reasonably suspect anomalous click velocity, bot traffic, fraud flags, Network policy violations, or other Fraudulent Activity. Flagged accounts stay unpaid until an admin completes a manual review. We may also delay, block, or reverse a payout when a Network reverses the underlying fee or when required by law.

Forfeiture of commissions generated via fraud. Any commissions, referral fees, or account balances derived directly or indirectly from fraudulent, non-compliant, or prohibited activities—or associated with accounts flagged by third-party partner networks—shall be immediately forfeited. Tapixy shall have no obligation to pay out any funds associated with fraudulent or unauthorized traffic and reserves the right to claw back any previously disbursed funds associated with non-compliant behavior.

Repayment, offset, and waiver. Any earnings that we determine were generated through Fraudulent Activity, self-referral, or in violation of these Terms or of any Network’s policies are permanently forfeited and will not be paid under any circumstances. Any such amounts already paid must be repaid on request, and we may offset them against any other balance. To the fullest extent permitted by law, you waive any claim to forfeited amounts, including claims based on quantum meruit, unjust enrichment, or similar theories.

11. Your content

You are responsible for your published looks, videos, and the accuracy of item titles and product links you confirm on the review screen. Do not upload content you do not have the rights to use. You grant Tapixy a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt (for example, cropping and thumbnails), and distribute your content to operate and promote the service. We may remove looks or suspend accounts that violate these Terms, Network policies, or the law.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee commissions, click-through rates, uptime, or that a detected item is the exact product in a video. Shoppers should verify item details on the merchant site before purchasing.

13. Binding individual arbitration and class action waiver

Arbitration. Except as stated below, any claim, dispute, or controversy between you and Tapixy arising out of or relating to these Terms or the service (a “Dispute”) will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules, seated in Santa Barbara County, California (or by video conference if the arbitrator allows). The Federal Arbitration Act governs this Section. The arbitrator, not a court, decides questions of arbitrability, except that a court decides whether the class action waiver below is enforceable.

Informal resolution first. Before starting arbitration, the party bringing a Dispute must email a written description of it to the other party (to us at contact@tapixy.com) and try in good faith to resolve it for 30 days.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek temporary injunctive relief in court to protect intellectual property or to stop Fraudulent Activity pending arbitration.

CLASS ACTION AND JURY WAIVER. YOU AND TAPIXY EACH WAIVE ANY RIGHT TO INITIATE, JOIN, CONSOLIDATE, OR PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST THE OTHER. DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS. YOU AND TAPIXY EACH WAIVE ANY RIGHT TO A TRIAL BY JURY.

Severability of this Section. If any part of this Section is found unenforceable as to a particular claim or remedy (such as public injunctive relief), that claim or remedy will be severed and brought in court under Section 14, after the arbitrable claims are decided, and the rest of this Section still applies.

14. Governing law and venue

These Terms and any Dispute are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. To the extent any Dispute is permitted to proceed in court rather than arbitration, it must be brought exclusively in the state or federal courts located in Santa Barbara County, California. You irrevocably submit to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.

15. Indemnification

You agree to defend, indemnify, and hold harmless Tapixy and its owners, operators, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to: (a) videos or other content you upload or publish, including any claim that it infringes copyright, trademark, privacy, or publicity rights; (b) your violation of these Terms or of any Network’s policies; or (c) any Fraudulent Activity attributed to your account or storefront.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPIXY’S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE LESSER OF (A) $100.00 USD OR (B) THE TOTAL NET CREATOR SHARE PAID TO YOU IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL TAPIXY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, EVEN IF ADVISED OF THEIR POSSIBILITY. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

17. Changes, termination, and general terms

We may update these Terms. The “Last updated” date will change, and for material changes we will notify creators by email or in the dashboard. Continuing to use the service after changes take effect means you accept them. You may close your account at any time; we may suspend or terminate accounts under Section 10 or for any violation of these Terms. Sections 5, 7, 8, 10, and 12–17 survive termination. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the rest of these Terms remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and Tapixy about the service.
